From time to time we may send you marketing communications by email or SMS, but only in accordance with the Spam Act 2003 (Cth) and, where applicable, the consent requirements of the laws described in “International Visitors”. You may withdraw your consent at any time.
To unsubscribe from email, open any newsletter from Alex Perry, scroll to the foot of the message, and select “Unsubscribe”. To stop SMS messages, reply with the opt-out keyword indicated in the message. You may also contact us at clientservices@alexperry.com.au to update your preferences.
Cookies and Online Tracking
When you visit our site, we and our service providers use cookies and similar technologies to operate the site, remember your preferences, understand how the site is used, and measure the performance of our communications and advertising. These technologies may collect information such as your device and browser type, IP address, the pages you view, and how you arrived at our site.
These tools fall into a few categories: those necessary for the site to function, those that help us understand and improve how the site is used (analytics providers), and those that help us measure and deliver our communications and advertising (marketing and advertising partners).
Where the law requires your consent before we place non-essential cookies, we will obtain it. You can also manage cookies through your browser settings at any time, though disabling some cookies may affect how the site functions.
Collection of Computer Data
Our servers automatically record certain technical information that your browser sends when you visit, which may include your IP address, browser type, the page you visited before arriving, the pages you view, time spent on those pages, items and information searched for, and access times and dates. We use this information in aggregate to analyse and improve our site, services and products. This data is not used in association with any other personal information.
Disclosure of Personal Information
We may disclose your personal information, in connection with any Purpose, to:
- Our employees, contractors and service providers, to the extent reasonably necessary to fulfil our obligations to you, including internet service providers, IT administrators, mailing houses, couriers, payment processors, and data service providers;
- Retail partners and suppliers who provide goods and services within our stores, and others who provide products and services to you on our behalf;
- Our professional advisors, including lawyers and accountants, to the extent reasonably required; and
- Suppliers and other third parties with whom we have commercial relationships, for business, marketing and related purposes.
We do not share, sell, rent or otherwise disclose your personal information except as described in this Privacy Policy.
How Shopify Is Involved
Our store and website are hosted by Shopify, which enables us to provide our services to you. As a result, information you submit is transmitted to and processed by Shopify, and may be shared with Shopify’s own service providers, some of whom may be located outside Australia, in order to provide and improve the services. To help us run and improve our business, we also use certain Shopify features that draw on data about your interactions with our store, with Shopify, and in some cases with other merchants on the Shopify platform. For some of this processing, Shopify acts as a controller of your personal information in its own right, including for responding to requests you make about how Shopify uses your information. You can read how Shopify handles personal information, and the choices available to you, in the Shopify Consumer Privacy Policy, and through the Shopify privacy portal.
Overseas Disclosure
Some of our service providers, including Shopify, store or process personal information outside Australia, and so your personal information may be disclosed to, or accessible by, recipients located overseas. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.
Your Rights and Choices
Depending on where you live, you may have some or all of the following rights in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request where permitted by law.
- Access. You may request access to the personal information we hold about you.
- Correction. You may request that we correct inaccurate personal information.
- Deletion. You may request that we delete personal information we hold about you.
- Portability. You may request a copy of certain personal information, and that we transfer it to a third party, where applicable.
- Objection and restriction. You may ask us to stop or restrict certain processing of your personal information.
- Withdrawal of consent. Where we rely on your consent, you may withdraw it at any time. This does not affect the lawfulness of processing before withdrawal.
- Opting out of targeted advertising. Depending on where you live, you may have the right to opt out of the “sale” or “sharing” of your personal information, or of its use for targeted advertising. Some of our advertising, including through Shopify and partners such as Meta and Google, may fall within these definitions.
Honouring browser signals. Where the law requires it, we treat a recognised Global Privacy Control signal from your browser or device as a request to opt out of targeted advertising for that browser or device. You can learn more at globalprivacycontrol.org.
Authorised agents. Where permitted by law, you may appoint someone to make a request on your behalf. We may ask them to prove they are authorised, and may ask you to verify your identity directly with us. We will not discriminate against you for exercising any of these rights, and we will respond within the time required by applicable law.
To exercise any of these rights, or to manage your marketing preferences, contact us at clientservices@alexperry.com.au.
International Visitors
Because we market and ship to customers outside Australia, additional data protection laws may apply to you. If you are located in the United Kingdom or the European Economic Area, the UK GDPR and EU GDPR may govern our handling of your personal information, and the following applies in addition to the rest of this policy.
Lawful basis. We process your personal information where it is necessary to perform our contract with you (for example, to fulfil your order), where we have a legitimate interest (for example, to improve and secure our services), where you have given consent (for example, to certain marketing), and where we are required to meet a legal obligation. The rights set out in “Your Rights and Choices” above are available to you, and you may also lodge a complaint with your local supervisory authority.
International transfers. Where we transfer your personal information out of the European Economic Area or the United Kingdom, we rely on a recognised transfer mechanism, such as the European Commission’s Standard Contractual Clauses or the equivalent issued by the relevant UK authority, unless the transfer is to a country recognised as providing an adequate level of protection.
Data Retention
We keep your personal information only for as long as it is needed for the purposes set out in this policy, generally for the duration of our relationship with you and for a reasonable period afterwards, together with any period required to meet our legal, tax, accounting and consumer-law obligations. When personal information is no longer needed, we securely destroy or de-identify it.
Security of Your Personal Information
We take reasonable steps to keep your personal information safe. We protect it by restricting access to those who need it, maintaining appropriate technical safeguards against unauthorised access, and securely destroying or de-identifying information when it is no longer required. Payment details are processed over an encrypted connection using current industry-standard encryption. That said, no method of transmission or storage is completely secure, and we cannot guarantee absolute security; we recommend you do not send sensitive information to us through unsecured channels.
Children
Our site is intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us and we will take appropriate steps to remove it.
Accessing and Updating Your Information
You can review and update your personal information at any time through your account on the Alex Perry website, or by contacting us at clientservices@alexperry.com.au.
Concerns and Complaints
If you believe your privacy has been breached, or you are not satisfied with how we have handled an enquiry, please contact us at clientservices@alexperry.com.au and we will work to resolve it. If you remain dissatisfied, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au, or, if you are in the United Kingdom or European Economic Area, your local data protection supervisory authority.
Changes to This Privacy Policy
We may modify this Privacy Policy at any time. Any changes will be published on our site and take effect when posted. We encourage you to review this page periodically.
